Land Bill to see two major changes - Real Estate India

New Delhi: Thanks to UPA chairperson Sonia Gandhi?s intervention, the land Bill will see two important changes before it is cleared by the Cabinet and introduced in Parliament.

First, there will be a distinction in the consent requirement from landowners/affected people between cases of government acquiring land for public-private partnership (PPP) projects with public purpose and purely private projects ? in the case of the former, consent from only 70% of landowners/affected people will be mandatory, while that from 80% of these people will be required for private companies? acquisition of land for their use.

Second, in the case of projects where land acquisition process has been under way for five years or more, the entire process will be nullified and brought under the new norms for a fresh start.

According to official sources, the final draft of the proposed Land Acquisition, Rehabilitation and Resettlement (LARR) Bill marks a departure from what was originally outlined in the Bill as vetted by the parliamentary standing committee.

The LARR Bill had spelt out that consent of 80% of landowners as well the people dependent on the land shall be required by both government and the private sectors.

Even a group of ministers (GoM) had batted for this 80% consent formula. However, with objections being raised by the ministries of commerce, road, defence and civil aviation, among others, the GoM watered it down to two-thirds consent of ?only landowners? before any land acquisition, without any distinction between government (PPP) and pure private sector players.

Now the land Bill is awaiting the nod from the law ministry. ?Once it is cleared by the law ministry, the land Bill will go for the Cabinet?s approval,? said a senior official.

For those land deals that are under work for less than five years, the provisions on rehabilitation, resettlement and compensation as mandated in the new land Bill will have to be followed but not the consent formula.

Of course, land acquisition by the government for PPP projects will have to adhere to the broad definition of ?public purpose? as being incorporated in the new land Bill. The list of public purpose projects include development of roads, bridges, ports, airport, urban public transport, telecommunication towers, three-star hotels, hospitals and educational institutes, among others.

Sources said the new land Bill will contain an exhaustive list of 29 infrastructure areas as involving public purpose. This means that the government can acquire land for PPP projects in these areas, provided the projects are majority-owned by the government and 70% of the landowners give their consent. Such public-purpose PPP projects will also be eligible for some concessions from state governments, which could reduce the cost of acquisition.

PPP projects driven by private companies, however, will have to fork out more for land and will require to get the consent of 80% of the landowners. The rehabilitation and resettlement policy would be tougher in their case and no government help would be forthcoming in acquiring land.

US federal mediators to join NHL labor talks

WASHINGTON (AP) ? Federal mediators are entering the stalled NHL labor talks, with the season's first 2? months already lost because of the lockout.

George Cohen, director of the Federal Mediation and Conciliation Service, said Monday the parties had agreed to use the agency. He assigned three mediators to assist negotiations ? deputy director Scot Beckenbaugh, director of mediation services John Sweeney and Commissioner Guy Serota ? who was removed later in the day because of a Twitter account that may have been tampered with.

The sides are to meet separately with the mediators Wednesday.

"While we have no particular level of expectation going into this process, we welcome a new approach in trying to reach a resolution of the ongoing labor dispute at the earliest possible date," NHL deputy commissioner Bill Daly said.

Cohen has worked with the players' associations for Major League Baseball, helping end the 1994-95 strike as an outside counsel, and the NBA. He was an adviser to the NHL players' union before joining FMCS three years ago.

"We look forward to their involvement as we continue working to reach an equitable agreement for both the players and the owners," said Donald Fehr, executive director of the NHL Players' Association.

Cohen mediated during the 2010 negotiations in Major League Soccer and 2011 talks in the NFL and NBA, along with this year's dispute between the NFL and its on-field officials.

Cohen said Serota was removed because "within one hour after I issued a press release ... it has been called to my attention that there are issues involving an allegedly hacked Twitter account associated with Commissioner Guy Serota." He said Serota was removed "to immediately dispel any cloud on the mediation process, and without regard to the merits of the allegations."

Hockey players and management have not negotiated since last Wednesday. The NHL has canceled more than one-third of its regular season, including all games through Dec. 14, the New Year's Day outdoor Winter Classic and the All-Star weekend scheduled for Jan. 26-27 at Columbus, Ohio.

"I have had separate, informal discussions with the key representatives of the National Hockey League and the National Hockey League Players' Association during the course of their negotiations for a successor collective bargaining agreement," Cohen said in a statement.

"Due to the extreme sensitivity of these negotiations and consistent with the FMCS's longstanding practice, the agency will refrain from any public comment concerning the future schedule and/or the status of the negotiations until further notice."

Beckenbaugh was a mediator during the 2004-05 lockout, a stoppage that caused cancellation of the entire season.

Detecting Cancer...With a Cellphone?

Smartphone technology is often seen as much of nuisance as it is a convenience, but having that kind of communicative power at our fingertips has a surprising advantage; it?s serving as a bridge, bringing healthcare to third world countries that had previously been too remote and too costly to reach.

The Kilimanjaro Cervical Screening Project is spearheading one use of smartphone technology in a way that?s surprisingly simple, but could end up saving thousands of women's lives.

Armed with screening kits, treatment tools and cellphones, teams of non-physician medical workers will visit remote locations in rural Tanzania to screen women for cervical cancer. Instead of the swab method used in the typical Pap smear, workers will use their cellphones to instead photograph a patient?s cervix, text the image to a physician and then receive back a diagnosis and treatment recommendation.

But can it really be that simple? Dr. Karen Yeates?of Queen's University, who is the lead investigator of the project, told CNN, "That's the beauty of it. For early grade cancers, those will be able to be treated right in the field, right in the rural area.?

According to the World Health Organization (WHO), rates of cervical cancer in Africa are up to ten times those in developed countries, and among those diagnosed, about?50,000 women die from it annually.

Though cervical cancer has very low mortality rates in developed countries like the U.S., those rates are generally due to our regular screenings, which catch the cancer in its earliest and most treatable incarnations.?However, in countries like Tanzania, women in remote villages obviously don't have access to those types of preventative measures. In fact, the WHO estimates that by the time most African women are diagnosed with the disease, they?ve already advanced into its latest fatal stages. But regular screenings could put a stop to that.?

The project is another way that the medical field is reimagining cellphones as a means of making healthcare rather effortlessly mobile in order to expand the world's access to it. Earlier this year, high school student?Catherine Wong discovered how to turn her cellphone into a portable ECG machine. Her invention will?bring heart monitoring capabilities to the most remote locations with results that could be beamed to doctors no matter how far away.

The Kilimanjaro Cervical Screening Project recently gained its funding from being named one of the 68 finalists in Canada?s Grand Challenges, a fund awarded to medical innovators who?ve invented new systems or products to bring healthcare to the poorest parts of the world. The project's $100,000 prize will allow it to begin its initial trials.

So much of good healthcare rests on the early detection of illness and now that geography and cost aren't the impediments they once were, patients in developing countries have real opportunities to survive illnesses once believed to be fatal.?

Exports, consumption drive meager German growth in third quarter

BERLIN (Reuters) - Exports and private consumption helped Germany to keep growing in the third quarter of 2012, albeit at a slower rate than previously, as Europe's largest economy felt the pinch of the euro zone crisis.

The Federal Statistics Office on Friday confirmed its initial estimate that German gross domestic product growth slowed 0.1 percentage points to 0.2 percent in the three months to end-September.

The breakdown showed exports supported growth in the third quarter, rising 1.4 percent, while government spending gained 0.4 percent and private consumption was up 0.3 percent.

Germany held up strongly during the first two years of the debt turmoil that has hammered Europe but a slide of a number of the continent's economies into recession and a worsening global outlook has prompted companies to hold off on investments.

The seasonally-adjusted data showed gross capital investment made no contribution to German growth in the third quarter.

"Businesses are investing less in machines and other equipment. The only explanation for that is a crisis of confidence - which means the German economy will lose more speed," said Holger Schmieding of Berenberg Bank.

Chipmaker Infineon has already said it will cut planned investments.

"The tough savings measures in southern Europe, weaker growth in China and uncertainty over the euro crisis are all contributing factors," said Schmieding.

Economists expect a contraction in the fourth quarter but forecast Germany will avoid a recession - defined as two consecutive quarters of quarter-on-quarter falls in GDP.

German business morale measured by the Ifo index is due at 0900 GMT and is expected to fall for the seventh successive month to the lowest in almost three years in November. Business expectations, however, are seen steady, pointing to a recovery next year.

Data this week showed service providers' expectations were the most downbeat since March 2009 as firms became more worried that clients would slash their budgets next year and that the euro zone crisis would hamper a German recovery.

Rep. Jackson Jr. resigns, citing mental health | Wichita Eagle

? Rep. Jesse Jackson Jr. quietly resigned Wednesday, effectively ending a once-promising political career months after the civil rights icon's son went on a mysterious medical leave while facing separate federal investigations.

Just two weeks after voters re-elected him to a ninth full term, Jackson sent his resignation letter to House Speaker John Boehner, citing his ongoing treatment for bipolar disorder and admitting "my share of mistakes."

The House Ethics Committee is investigating his dealings with imprisoned ex-Illinois Gov. Rod Blagojevich, and for the first time Jackson publicly acknowledged reports of a new federal probe believed to be looking into his possible misuse of campaign money.

"I am aware of the ongoing federal investigation into my activities and I am doing my best to address the situation responsibly, cooperate with the investigators, and accept responsibility for my mistakes," he wrote, adding "they are my mistakes and mine alone."

Jackson, 47, disappeared in June, and it was later revealed that he was being treated at the Mayo Clinic for bipolar disorder and gastrointestinal issues. He returned to his Washington home in September but went back to the clinic the next month, with his father, the Rev. Jesse Jackson, saying his son had not yet "regained his balance."

On Wednesday night, Jackson told reporters that his son resigned because he did not believe he could continue with his political career and try to regain his health at the same time.

"He made the decision to choose his health," said Jackson.

The elder Jackson said that his son had wanted to hold a news conference to discuss his decision to step down but did not believe he could do so without "breaking down."

He also said there is no way of knowing how long it will take for his son to recover from what he characterized as an "internal unresolved challenge."

"It's not the kind of illness you can put a timetable on," Jackson said, adding that he is confident that his son "will get well in time."

Jesse Jackson Jr. first took office in 1995 after winning a special election in a largely urban and Democratic district and began his career in Washington with a star power and pedigree that set him apart from his hundreds of other House colleagues.

But despite high expectations, he largely went unnoticed as a policymaker. Instead, he gained a reputation for quixotic pursuits such as trying to impeach President George W. Bush and push through constitutional amendments that had no chance.

He attended an elite private school in Washington and earned a law degree and a master's in theology. Over the years he bragged about spending his 21st birthday in jail after being arrested in an anti-apartheid protest, co-authored books with his father and developed his own a charismatic speaking style, with near perfect diction and often punctuated by finger pointing.

Shortly after taking office, he was deemed People magazine's sexiest politician in 1997 and became one of the most outspoken and quoted liberals in the House. There was a near-Hollywood buzz over his newly svelte figure in 2005 when he quietly dropped 50 pounds, disclosing months later that he had had weight-loss surgery.

Perhaps his shining moment as a Democratic leader was in 2008, when Jackson served as the national co-chair of Barack Obama's presidential campaign. He had his sights set on U.S. senator or Chicago's mayor.

Then came Blagojevich.

Though never charged, Jackson had to repeatedly dodge allegations that he was involved in discussions about raising campaign funds for the now-imprisoned former governor in exchange for an appointment to Obama's vacated U.S. Senate seat.

Jackson - who testified at Blagojevich's second corruption trial - always maintained that he was innocent and that his name would be cleared. Through the proceedings it was revealed that Jackson had an extramarital affair, something his wife detailed in a front-page newspaper interview.

The congressman kept a low profile for years, avoiding interview requests and public appearances.

It wasn't until this year that glimpses of Jackson's former self emerged. He was forced to campaign seriously for the first time in years when former Rep. Debbie Halvorson put up an intense primary challenge. He easily won and gave a triumphant victory speech with his wife and children by his side.

Neither Jackson's family nor staff ever fully explained what was happening with the congressman's health or if he'd return at all. A few times, staff seemed optimistic and so did voters in his Chicago-area district where he easily won re-election to a ninth full term this month despite, despite his only communication with voters coming through a robocall in which he asked for patience.

The timing of Jackson's leave and the way it was handled invited more scrutiny. Jackson's leave was announced just after a former fundraiser connected to the Blagojevich allegations was arrested on unrelated medical fraud charges.

The resignation left the House committee's investigation in the air. Since Jackson is no longer a congressman, the panel no longer has the power to punish him but could release a final report detailing its findings. A committee spokesman did not immediately return a message on Wednesday.

Reaction to his resignation was swift.

Democratic Leader Nancy Pelosi said in a statement that she'd spoke with both Jesse Jackson Jr. and his father Wednesday afternoon and accepted the news with "great sadness."

Rep. Danny Davis, a fellow member of Congressional Black Caucus, said Jackson's senior position on the House Appropriations Committee and his leadership would be missed. But he also said the way in which Jackson was leaving tarnished his image.

"It certainly does not leave his legacy untouched in as positive light as one would have hoped and wanted," he said.

He declined to comment on the federal investigation, saying he had no details, but the issue did appear to resonate with some voters.

"It was time," said retiree Gloria Pryor, who has voted for Jackson several times. "If he's done the things he's accused of doing then he should leave and apologize to the people of this community."

The vacancy left by Jackson's departure creates a rare opportunity for someone else to represent his district, which is made up of South Side Chicago neighborhoods, several southern suburbs and some rural areas.

Even before the resignation the gambit of potential successors floated around Chicago. Prominent Chicago attorney Sam Adam Jr., a onetime attorney for Blagojevich and R&B singer R. Kelly, said he'd be interested. Other names circulating are Chicago Aldermen Sandi Jackson and Anthony Beale, Cook County Board President Toni Preckwinkle and Halvorson.

Illinois Gov. Pat Quinn, a Democrat, has five days to schedule an election to replace Jackson, and the election must be held within 115 days, according to election officials. Quinn said he planned to schedule both a primary and a general election.

A genuinely funny and touching film that, in less than a decade, has established itself as a timeless classic.

It makes even more compelling what is still my all-time favorite Pixar film.

Think of this re-release as an encore, a handy touchstone for you and your kids. "Finding Nemo" was and remains the gold standard against which all other modern animated films are measured, a classic from the day it premiered.

In this seamless blending of technical brilliance and storytelling verve, the Pixar team has made something as marvelously soulful and innately, fluidly American as jazz.

Nemo, with its ravishing underwater fantasia, manages to trump the design glamour of earlier Pixar films.

I don't exactly worship Pixar, but "Finding Nemo" is truly a great film.

Gill is Platoon's Sgt. Elias if he'd survived Sgt. Barnes' treachery and returned to civilian life weary and hard-bitten from his experiences. And also a fish.

Finding Nemo 3D is a quality post-conversion experience that successfully enhances the 2003 film's original standout visuals.

The 3D gives the images a little more depth but they already had heft and weight. The 3D is a money-making gimmick, nothing more.

A great blend of storytelling and technology.

It's downright curmudgeonly to remain focused on the negatives when the rest of the picture is saturated with invention and wit.

It's bright, it's beautiful and it hasn't aged a day. So why, then, do we need to see it in 3-D?

A rare example of a movie that not only survives its 3-D conversion but benefits from it

It was as funny as I remember and brilliant because it is subtle. It just knocks it out of the park. I love everything about this movie, one of my favorite Pixar movies of all time, 5/5 Schmoes. The new sound/3D adds to the greatness that is Nemo.

If you're fishing for fun in an ocean of movie mediocrity, grab the kids or the grandkids, fork out a few extra bucks and see this one in three-dimensions.

It's a great movie, so much fun, an acheivement that should be enjoyed by children of all ages and worth seeing it in 3D.

Sea-worthy w/enhanced visual lure and rich, humorous characters set in a double narrative; this 3D revisit allows us to fall overboard all over again.

If ever there was a film that wasn't broke, this is it. So naturally they converted it into 3D for a special re-release this weekend. (Stupid irony.)

I believe my sensitivity to certain creative choices of the picture has dulled some, while age has opened my eyes to its complex relationships and tireless sense of exploration.

At its best, the added dimension is merely harmless, making the movie blurry enough that you need special glasses to make it sharp again.
